Aylesbury Vale District Council • Designated Public Places Order

Designated Public Places Order

A number of areas in Aylesbury Vale have been identified by the Community Safety Team, Thames Valley Police and AVDC Open Spaces Team as having issues with public drinking and drink related incidents. This includes an area of Steeple Claydon (details below)

AVDC has made Orders (Aylesbury Vale District Council (Alcohol Consumption in Designated Public Places) Order 2008) to designate lands as public places pursuant to the provisions of the Criminal Justice and Police Act 2001. The proposed Order will apply the provisions of section 12 of the Criminal Justice and Police Act 2001 to a number of public spaces within the district of Aylesbury Vale pursuant to section 13 of the Criminal Justice and Police Act 2001.

The effect of the proposed Order is to grant the police the power to require a person in a designated area not to consume alcohol and to surrender opened containers containing alcohol. It is not intended to implement a comprehensive ban on drinking in the open air but rather to eliminate anti-social drinking and the associated nuisance, annoyance and disorder. The following places are excluded from the Designated Public Place Order.

a) Premises where a premises licence or club premises certificate is in force to serve alcohol under the Licensing Act 2003 and places within the curtilage of these premises (e.g. pubs, clubs, restaurants, off-licences).

b) Premises where the Council hold a premises licence or the premises licence is held on behalf of the Council which authorises the sale and supply of alcohol – NB the order will not apply only at times when alcohol is being served under the licence and 30 minutes thereafter.

c) Premises subject to a Temporary Event Notice under the Licensing Act 2003 – NB the order will not apply only at times when alcohol is being served under the licence and 30 minutes thereafter.

d) Places where the sale or consumption of alcohol is permitted on public highways under s. 115E of the Highways Act 1980 (highway related uses).
